Terms and Conditions for The Growth Movement Membership

The following Terms and Conditions of membership (“Terms and Conditions”) apply to all membership agreements entered into, by and between the member named in the membership agreement (“the Member”) and The Growth Movement ABN 696 345 046 71 and each related entity (as defined in the Corporations Act 2001) from time to time and any of The Growth Movement assigns. This agreement extends to any entity which is not now but is in the future a related entity of The Growth Movement. These Terms and Conditions also apply to all products and services supplied to the Member by The Growth Movement under any account whatsoever.

1. Introduction

  • By registering for membership to The Growth Movement, you agree to be bound by these Terms and Conditions.

2. Membership Options

  • We offer two membership options: 
    • a 6-month membership and 
    • A 12-month membership.

3. Payment Terms

  • Upon registration, you are obligated to pay the full amount for the chosen membership duration. Payment plans may be available; however, the total amount remains due irrespective of payment frequency.
  • Any payment plan offered is not a subscription and is independent of the membership itself. The payment plan allows the Member to purchase the membership and pay off the total amount in instalments. The Member remains fully liable for the entire value of the membership, regardless of the payment method chosen.
  • There are no refunds for the membership once you register. By agreeing to these terms, you acknowledge and accept this no-refund policy.
  • Any missed or failed payments will result in the revocation of membership access until any overdue payments are received in full.

4. Intellectual Property and Membership Access

  • The Growth Movement grants the Member a limited, non-exclusive, non-transferable licence to access our intellectual property (“IP”) solely for the purpose of participating in the membership. This IP remains the property of The Growth Movement at all times.
  • Members are strictly prohibited from copying, distributing, reproducing, or sharing the IP in any form. Access to the IP is granted exclusively for the purpose of the membership and personal use within the membership context.
  • Members will only have access to the IP for the duration of their membership. Upon conclusion of their membership, access to the IP will be terminated.
  • Access to the online portal and all membership content is granted solely to the individual who registered for the membership. Sharing login details or allowing others to access the portal is strictly prohibited and will result in immediate termination of membership without a refund.

5. Member Responsibility and Code of Conduct

  • It is the responsibility of the Member to ensure that the membership is suited to their needs prior to registration. By agreeing to these Terms and Conditions, the Member acknowledges that they have reviewed the membership offerings and determined their suitability for their purposes.
  • Members agree to maintain a high level of respect towards the individuals delivering the membership content as well as their fellow members. Members shall uphold stringent confidentiality regarding all information shared within this membership, including, but not limited to, information pertaining to other members. Any form of harassment, discrimination, or inappropriate behaviour is strictly prohibited and will not be tolerated. Members are expected to conduct themselves in a professional manner at all times.

6. Member Expectations

  • It is expected that members will make all efforts to attend the live training and Q&A calls and complete all modules and lessons as they become available.

7. Inclusions

  • The membership content will include a mix of live calls and pre-recorded video content, as well as various tools and resources.
  • Content will be provided as a combination of readily available material and content that will be drip-fed throughout the duration of the membership.

8. Facilitation of Membership

  • The membership is facilitated by expert team members and representatives of The Growth Movement, as well as external guests. Members should not expect that the entire membership will be conducted by Sonja Pototzki-Raymond, also known as Sonja The Search Queen.

9. Recommendations, Liability, and Disclaimer of Results

  • All information, guidance, and coaching provided through this membership are intended as recommendations only. We disclaim any and all liability for any damages, losses, or adverse outcomes resulting from a member’s implementation of the advice provided.
  • Any financial advice furnished as part of this membership is solely for informational purposes and should not be construed as professional financial advice. Members are strongly advised to seek the counsel of a licensed financial advisor prior to making any financial changes or decisions.
  • The Growth Movement makes no guarantees or warranties as to the results or outcomes that may be achieved through participation in the membership. It is the sole responsibility of the Member to actively partake in and engage with the membership content to realise its full potential. Even with full participation, there is no assurance of any specific results or outcomes.

10. Termination

  • We reserve the right to terminate your membership at any time for breach of these Terms and Conditions or for any conduct we deem detrimental to the membership community.
  • In the event of termination, no refunds will be issued.

11. Limitation of Liability

  • We shall not be liable for any direct, indirect, incidental, or consequential damages arising from your use of the membership portal or any content provided therein.
  • The membership and all content are provided on an “as is” basis without warranties of any kind, either express or implied.

12. Changes to Terms and Conditions

  • We reserve the right to update or modify these Terms and Conditions at any time. Members will be notified of any changes, and continued use of the membership will constitute acceptance of the revised terms.

13. Governing Law

  • These Terms and Conditions shall be governed by and construed in accordance with the laws of Western Australia, Australia.

14. Privacy Policy

  • We are committed to protecting your privacy. All personal information collected from Members will be handled in accordance with our Privacy Policy, which can be viewed [insert link to Privacy Policy].

15. Data Security

  • We implement appropriate technical and organisational measures to ensure the security of your personal data against accidental or unlawful destruction, loss, alteration, unauthorised disclosure, or access.

16. Dispute Resolution

  • Any disputes arising out of or relating to these Terms and Conditions shall be resolved through negotiation in good faith. If a resolution cannot be reached, the dispute shall be submitted to mediation before resorting to any other dispute resolution procedure. Should further dispute resolution procedures be necessary, they will take place within the state of Western Australia only.

17. Force Majeure

  • The Growth Movement shall not be liable for any failure to perform its obligations hereunder due to causes beyond its reasonable control, including but not limited to acts of God, war, riots, embargoes, acts of civil or military authorities, fire, floods, accidents, strikes, illness or shortages of facilities and resources.

18. Indemnification

  • The Member agrees to indemnify, defend, and hold harmless The Growth Movement, its affiliates, officers, agents, and employees from any claim or demand, including reasonable attorneys’ fees, made by any third party due to or arising out of the Member’s use of the membership, violation of these Terms and Conditions, or violation of any rights of another.

19. Modification of Services

  • The Growth Movement reserves the right to modify or discontinue, temporarily or permanently, the services provided as part of the membership with or without notice.

20. Use of Information

  • The Member grants The Growth Movement the right to use information such as results, data, testimonials or feedback for marketing and promotional purposes.

21. Membership Transfer

  • Memberships are non-transferable and may not be assigned to any other individual or entity.

22. Entire Agreement

  • These Terms and Conditions, together with any membership agreement, constitute the entire agreement between you and us with respect to the membership and supersede all prior or contemporaneous communications and proposals, whether oral or written.

23. Severability

  • If any provision of these Terms and Conditions is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.

24. Waiver

  • Our failure to enforce any right or provision of these Terms and Conditions will not be considered a waiver of those rights.

25. Notices

  • All notices and other communications under these Terms and Conditions shall be in writing and shall be deemed to have been duly given when delivered in person, sent by registered or certified mail, or by email to the respective parties at their designated addresses.
