Section 1 – What do we do with your information? 

  • When you purchase something from our store, as part of the buying and selling process, we collect the personal information you give us such as your name, address and email address.

    When you browse our store, we also automatically receive your computer’s internet protocol (IP) address in order to provide us with information that helps us learn about your browser and operating system.

    Email marketing (if applicable): With your permission, we may send you emails about our store, new products and other updates.

2. Consent

  • How do you get my consent?

    When you provide us with personal information to complete a transaction, verify your credit card, place an order, arrange for a delivery or return a purchase, we imply that you consent to our collecting it and using it for that specific reason only.

    If we ask for your personal information for a secondary reason, like marketing, we will either ask you directly for your expressed consent or provide you with an opportunity to say no.

    Once you leave our store’s website or are redirected to a third-party website or application, you are no longer governed by this Privacy Policy or our website’s Terms of Service.

5. Security

  • To protect your personal information, we take reasonable precautions and follow industry best practices to make sure it is not inappropriately lost, misused, accessed, disclosed, altered or destroyed.

    If you provide us with your credit card information, the information is encrypted using secure socket layer technology (SSL) and stored with a AES-256 encryption. Although no method of transmission over the Internet or electronic storage is 100% secure, we follow all PCI-DSS requirements and implement additional generally accepted industry standards.

    _lsite_uniq, no data held, expires midnight (relative to the visitor) of the next day, Counts the number of visits to a store by a single customer.

    storefront_digest, unique token, indefinite If the shop has a password, this is used to determine if the current visitor has access.

    If our store is acquired or merged with another company, your information may be transferred to the new owners so that we may continue to sell products to you.

  • We shall not be liable for any direct, indirect, incidental, or consequential damages arising from your use of the membership portal or any content provided therein.
  • The membership and all content are provided on an “as is” basis without warranties of any kind, either express or implied.

12. Changes to Terms and Conditions

  • We reserve the right to update or modify these Terms and Conditions at any time. Members will be notified of any changes, and continued use of the membership will constitute acceptance of the revised terms.

13. Governing Law

  • These Terms and Conditions shall be governed by and construed in accordance with the laws of Western Australia, Australia.

16. Dispute Resolution

  • Any disputes arising out of or relating to these Terms and Conditions shall be resolved through negotiation in good faith. If a resolution cannot be reached, the dispute shall be submitted to mediation before resorting to any other dispute resolution procedure. Should further dispute resolution procedures be necessary, they will take place within the state of Western Australia only.

17. Force Majeure

  • The Growth Movement shall not be liable for any failure to perform its obligations hereunder due to causes beyond its reasonable control, including but not limited to acts of God, war, riots, embargoes, acts of civil or military authorities, fire, floods, accidents, strikes, illness or shortages of facilities and resources.

18. Indemnification

  • The Member agrees to indemnify, defend, and hold harmless The Growth Movement, its affiliates, officers, agents, and employees from any claim or demand, including reasonable attorneys’ fees, made by any third party due to or arising out of the Member’s use of the membership, violation of these Terms and Conditions, or violation of any rights of another.

19. Modification of Services

  • The Growth Movement reserves the right to modify or discontinue, temporarily or permanently, the services provided as part of the membership with or without notice.

20. Use of Information

  • The Member grants The Growth Movement the right to use information such as results, data, testimonials or feedback for marketing and promotional purposes.

21. Membership Transfer

  • Memberships are non-transferable and may not be assigned to any other individual or entity.

22. Entire Agreement

  • These Terms and Conditions, together with any membership agreement, constitute the entire agreement between you and us with respect to the membership and supersede all prior or contemporaneous communications and proposals, whether oral or written.

23. Severability

  • If any provision of these Terms and Conditions is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.

24. Waiver

  • Our failure to enforce any right or provision of these Terms and Conditions will not be considered a waiver of those rights.

25. Notices

  • All notices and other communications under these Terms and Conditions shall be in writing and shall be deemed to have been duly given when delivered in person, sent by registered or certified mail, or by email to the respective parties at their designated addresses.
